BOOKING CONDITIONS

Our booking conditions are as follows:

By paying a trip deposit you, the ('Customer') acknowledge Active Downunder does not own or operate any of the suppliers of services, accommodations, transportation, airlines, cruise, tours or guides ('Service Providers') for my trip. As a result, it is not responsible for any negligent or willful act or failure to act of any 'Service Provider' or of any other third party over whom Active Downunder has no control. In using Active Downunder to book, reserve and pay for custom travel arrangements, you, the Customer agree to be bound by these booking conditions. Active Downunder also agrees to these booking conditions to provide it's services to Customer.

 

Active Downunder is deemed an independent contractor for all purposes under these 'Booking Conditions'. Active Downunder acts solely for the facilitation and reservation of travel services and is not responsible for any monies held by any 'Service Provider'. If cancellation of travel falls within the non-refundable dates, Active Downunder may not be held responsible to retrieve those funds.
 

Deposit and Balance of Payments
To begin the reservation process:

$250 planning fee for trips under 3 weeks; $500 trips for over 3 weeks or multi country. This fee is due prior to designing your itinerary and will be deducted from your final payment.

A deposit of US*$1000 per person is required for all bookings.
*Some bookings will require a higher deposit, you will be notified at time of booking.

 

The balance of payment is required 60 days prior to departure date or, if booking within this period, full payment is due immediately upon booking confirmation. If your payment is not received on time, your reservation will be cancelled. All deposits are non-refundable. All pricing is subject to change until paid in full.

Package Pricing

Our custom itineraries are priced as a package. We do not breakdown or itemize package pricing. Our terms apply to all components within the package.
 

Cancellation
All changes and cancellations must be received in writing. 

 

  • Trip Planning Fee: non-refundable

  • Trip Deposit:  non-refundable

  • More than 60 days prior: 25% of trip cost is non-refundable

  • 31-60 days prior: 50% of trip cost is non-refundable

  • 0-30 days prior: 100% of trip cost is non refundable

Full Payment
Is due 60 days prior to departure date or immediately if within that period. Some 'Service Providers' may require earlier payment. Customer will be notified at time of booking if earlier payment is required.

Travel Insurance
For your protection We STRONGLY RECOMMEND purchasing travel insurance at time of booking. Travel Insurance can be purchased to cover all penalties in the event you need to cancel or change travel plans.  Travel Insurance is non-refundable.

Payments

  • Credit Cards: We accept Visa, Mastercard, Discover and American Express.

  • Check: Payable to Active Downunder, 1220 Rosecrans Street, # 911, San Diego, CA 92106.

  • Wire Transfer: bank, routing and account number provided upon request

Cruise Cancellations

Cancellation policies for cruises vary by cruise line. You will be advised of their cancellation policy at time of booking. Note: most cruises are non-refundable.

Air Reservations
With excellent contacts and buying power through our affiliation with Protravel International we act as a 'sales agent' for the airlines to provide our 'Customers' with a full service air booking service. For this service we charge $50 per person ticketing fee. If you need to change or rebook your trip a $50 per person fee will be charged in addition to any airline change fees or fare changes. Note: We have no control over the airlines services, schedules or refund policies. Airline tickets have strict change/cancellation policies and are 100% non-refundable. Customer is responsible for provide a copy of their passport page and ensuring the names shown on their airline reservation are correct prior to tickets being issued. Ticket re-issue fee of $250 per person will be assessed if customer fails to provide a copy of their passport page.
 
Frequent Flyer Miles

We are happy to add your frequent flyer number to your booking. If you are accruing frequent flyer miles on any of the airlines used on your Active Downunder itinerary, please verify at check-in that your mileage plans are in place. Also, be sure to keep all of your ticket receipts for proof of travel should mileage not appear on future Statement. A $50 charge will be assessed if Active Downunder is asked to produce ticket copies.
 
Seating Requests
We are pleased to make a seating request for your travel. Please note, seating requests are 'requests' only. While we may be able to provide you a 'seat number', this seat is not guaranteed until check-in. Airlines reserve the right to change seating requests. Active Downunder is not responsible for the seat you are assigned.
 
Nominated Industry Partners
Active Downunder ('Independent Contractor') works in conjunction with Airlines, Destination Management Companies, Inbound Operators and Wholesalers around the world to offer Customers a wide range of Travel Related Services.

Affiliations
We are affiliated and work as an 'Independent Contractor' 
with Protravel International.
 

Prices
All prices quoted in US dollars and inclusive of local taxes. Note: some hotels or resorts may have additional taxes to be paid in country. Active Downunder or it's nominated industry partners reserve the right to amend pricing without notice and are subject to change until final payment is received. All quoted prices will be guaranteed once final payment has been received. We do not itemize or breakdown pricing for any of our packages or custom designed itineraries. Please note: currency fluctuations do occur and price adjustments are made from time to time to accommodate the fluctuations.
 
Amendments
Once an itinerary has been designed, priced and agreed upon, your reservations will be confirmed. A change fee of $35 per change will be charged if any changes are made after confirmation and before issuance of documents. Changes made between 15-30 days prior to departure, or after documents are issued, will be charged $60 per change. A fee of $85 per change will be assessed for changes made within 14 days prior to departure. If such changes necessitate cancellation of confirmed air or ground arrangements, unrecoverable costs will be added to the change fee.

Limitation of Liability: 
Active Downunder shall not be liable for any claims, losses, damages, costs, expenses, delays, sickness, injury, or loss of enjoyment, of any nature or kind whatsoever, resulting from events beyond Active Downunder' or a Service Provider's reasonable control. In no event will Active Downunder' liability exceed the total amounts Customer paid Active Downunder for Customer's travel. Active Downunder assumes no responsibility for lost tickets, documents, passes, or vouchers.  Further, Active Downunder shall not be liable for any injury, loss, claim, damage or any special, punitive, indirect, consequential, incidental damages of any kind, whether based on contract, tort, strict liability or otherwise, which may arise as a result of the use of booking travel services with Active Downunder and those of its Service Providers.


 In the case of Force Majeure, an event beyond the control of the Customer and Service Provider, including:
a.  Act of God (including, but not limited to, fires, explosions, earthquakes, drought, tidal waves, and floods, riots, war, civil disturbance, strikes including strikes by Service Providers);
b. Plague, epidemic, pandemic, outbreaks of infectious disease or any other public health crisis, including quarantine or other employee restrictions; or
c.  Government acts such as quarantine restrictions, border closures, travel bans, denial of entry, or personal history (e.g., court records or travel restrictions).

Acting with the laws governing the travel industry in the State of California, in the case of a Force Majeure, Active Downunder shall not be liable for any claims nor be responsible for retrieving funds from the Service Provider on behalf of the Customer. Active Downunder may, in its sole discretion, advocate on behalf of the Customer for the return of amounts paid and reserves the right to take any action that Active Downunder deems appropriate under the circumstances.

In a Force Majeure event, if the Service Provider is prevented from carrying out its obligations, Active Downunder will not be held accountable for retrieving funds and is entitled to keep no less than the deposit. In no circumstance will Active Downunder’ liability exceed the total amounts the Customer paid.

California Seller of Travel
Active Downunder is a registered California Seller of Travel, Reg No. 2060868-40

Travel Consumer Restitution Corporation (TCRC)
Active Downunder is a participant in the Travel Consumer Restitution Corporation (TCRC). You, the passenger, may request reimbursement from TCRC if you are owed a refund of more than $50 for transportation or travel services which was not refunded in a timely matter by a seller of travel who was registered and participating in the TCRC at the time of sale. The maximum amount which may be paid by the TCRC to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000. A claim must be submitted to the TCRC within six months after the scheduled completion date of the travel. A claim must include sufficient information and documentation to prove your claim and a $35 processing fee. You must agree to waive your right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which you file a claim with the TCRC, if you were located in California at the time of the sale. You may request a claim form by writing to: Travel Consumer Restitution Corporation, P O Box 6001, Larkspur, CA 94977-6001; or by faxing a request to: (415) 927 7698. Customers located outside of California. This transaction is not covered by the California Travel Consumer Restitution Corporation. California law requires certain sellers of travel to have a trust account. Active Downunder has a trust account held with Wells Fargo.
